Refund Policy

1. All sales final
Because Elara is delivered as digital software and access is granted immediately upon purchase, all sales are final and non-refundable except where a refund is required by law.
2. Australian Consumer Law
Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other law that cannot lawfully be excluded.
You are entitled to a remedy where Elara fails to comply with a non-excludable consumer guarantee — for example, where the service is not supplied with due care and skill, or is not reasonably fit for a purpose disclosed by us. Where the failure is "major" you may be entitled to a refund; otherwise we may, at our option, provide a re-supply or repair of the affected service.
3. Outside non-excludable rights
Outside the non-excludable rights described above, no refunds will be provided, including (without limitation) for: change of mind; failure to use the service; dissatisfaction with AI-generated output; loss of access caused by clearing your browser data; or termination of your licence for breach of the Terms of Service.
4. Waiver
To the maximum extent permitted by law, you waive any right to a refund except where such waiver is not permitted by law.
5. How to request a remedy
To claim a remedy under the ACL, email nexus.systems.au@gmail.com with your purchase details and a description of the issue. We will respond within a reasonable time.
