Refund, Cancellation & Dispute Policy

1. Subscriptions and cancellation
Elara is delivered as an auto-renewing subscription. You may cancel at any time from your billing portal. On cancellation, your access continues until the end of the period you have already paid for and is not renewed. Because access is granted immediately at the start of each period, partial-period refunds for the current billing period are not provided except where a refund is required by law.
2. Australian Consumer Law
Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other law that cannot lawfully be excluded.
You are entitled to a remedy where Elara fails to comply with a non-excludable consumer guarantee — for example, where the service is not supplied with due care and skill, or is not reasonably fit for a purpose disclosed by us. Where the failure is "major" you may be entitled to a refund; otherwise we may, at our option, provide a re-supply or repair of the affected service.
3. Outside non-excludable rights
Outside the non-excludable rights described above, no refunds will be provided, including (without limitation) for: change of mind; failure to use the service; dissatisfaction with AI-generated output; loss of access caused by clearing your browser data; or termination of your subscription for breach of the Terms of Service. Historical one-time "lifetime" license purchases (prior to the subscription launch) remain non-refundable and continue to grant access as originally sold.
4. Waiver
To the maximum extent permitted by law, you waive any right to a refund except where such waiver is not permitted by law.
5. How to request a remedy
To claim a remedy under the ACL, email nexus.systems.au@gmail.com with your purchase details and a description of the issue. We will respond within a reasonable time.
6. Altered or self-modified copies
Elara can be modified by you — prompts, plugins, connected services, offline builds and, in the downloadable editions, the copy's own source. Where a problem is caused by an alteration made by you or by anyone other than Nexus Systems World, it is not a fault in the product and is not a ground for a refund or remedy. Details in Warranty & Alterations. This does not affect a remedy for a fault that existed before and independently of your alteration.
7. Disputes and chargebacks
- Talk to us first. Email nexus.systems.au@gmail.com with your serial number, the email used at checkout, the date, the amount and what went wrong.
- We acknowledge within 5 business days and aim to resolve within 20 business days.
- If we cannot agree, you may escalate to your card issuer or to a consumer body — in Australia, your state fair-trading office or the ACCC (accc.gov.au). Privacy complaints go to the OAIC (oaic.gov.au).
- Raising a chargeback before contacting us slows things down and, where the charge was valid, access may be suspended until the dispute is resolved. We will supply the payment processor with the purchase record, serial number, access logs and this policy as evidence.
- All amounts are charged in Australian dollars (AUD). Your bank's conversion rate and any foreign-transaction fee are set by your bank, not by us, and are not refundable by us.
- Fraudulent or abusive disputes (for example, disputing a charge for a product that continues to be used) may result in termination of access under the Terms.
8. Governing law
This policy is governed by the laws of Queensland, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction. Nothing here removes a right you have under the mandatory consumer law of your own country of residence.
