1. Where Elara is available

Elara is a digital product supplied over the internet and is available in every country where it is lawful for you to receive it. You may select your country, display language and display currency at any time using the selector above or in the site footer. Your selection is stored on your own device only and is used solely to present the site to you.

2. All sales are in Australian dollars

Every price, subscription, add-on and one-time purchase is denominated and charged in Australian dollars (AUD), regardless of the currency you have chosen to view. This is the contractual price.

Where a figure is shown in another currency it is an estimate for information only. It is converted from AUD using the European Central Bank reference rate (retrieved at page load; a saved rate is used if that lookup fails, and this is disclosed on screen). It is not an offer to sell in that currency, is not binding, and is never the amount sent to our payment provider.

Billed in Australian dollars (AUD). Any sales tax, VAT or GST that applies where you live is calculated and shown at checkout. Your bank or card issuer converts the Australian dollar charge at its own rate and may add a foreign transaction fee. We do not receive that fee.

3. Your bank's conversion and fees

Because the charge is made in AUD, your bank, card issuer or payment provider performs the conversion into your local currency at its own rate, on its own date, and may add a foreign currency or international transaction fee. The final amount debited from your account may therefore differ from any estimate shown on this site. We do not set, receive or control that rate or fee.

4. Taxes, VAT and GST

Sales tax, VAT or GST applicable to your location is calculated at checkout by our payment provider and shown to you before you confirm payment. Where you are a business purchaser required to self-assess tax in your jurisdiction, that assessment remains your responsibility. You must not use the service in a way that misrepresents your place of residence in order to alter the tax applied.

5. Language of the agreement

Our legal documents are written in English. The English version is the authoritative version; translations are provided for convenience only.

Interface translations are provided to help you understand the product. They are not legal advice and do not vary the Terms of Service, Privacy Policy, Refund Policy or AI Disclaimer. Where a translation conflicts with the English text, the English text prevails.

6. Your local consumer rights

The agreement is governed by the laws of Queensland, Australia. Nothing in our terms excludes, restricts or modifies:

• consumer guarantees under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law; or
• any right or remedy available to you under the mandatory consumer protection law of your own country of residence that cannot lawfully be excluded by agreement.

If you are a consumer in the EU, UK or another jurisdiction with mandatory withdrawal or cancellation rights for digital services, those rights apply to you in addition to this policy. Email us and we will honour them.

7. Export, sanctions and lawful use

You must not purchase or use Elara if doing so would breach Australian sanctions law, the export control laws applying to us or our suppliers, or the laws of your own country. Some features (for example web-access agents, or AI image generation) may be restricted or unlawful in certain jurisdictions. Confirming that your intended use is lawful where you are is your responsibility.

8. Cross-border data

Elara is hosted on infrastructure that may process and store data in Australia, the United States and the European Union, and uses third-party AI, payment and email providers who may do the same.
