1. Personal Software, Not a Service
Elara Companion is a personal piece of software built and operated by its sole owner for the owner's own private use. Copies sold or otherwise distributed do not create a service relationship, agency, partnership, employment, fiduciary duty, or any obligation of support, maintenance, updates, uptime, or availability.
2. No Warranty
ELARA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, SECURITY, AND NON-INFRINGEMENT. The owner does not warrant that Elara will meet your requirements, operate without interruption, be secure, or be free of errors, viruses, or other harmful components.
3. Not Professional Advice
Elara is a companion, journaling, and ideation tool. It is not a substitute for professional advice. Nothing produced by, said by, or stored in Elara is medical, mental-health, psychological, psychiatric, therapeutic, legal, financial, tax, insurance, safety, parenting, relationship, or any other form of professional advice. Always consult qualified professionals for decisions affecting your health, safety, finances, or legal rights.
4. Not for Emergencies
ELARA IS NOT A CRISIS, EMERGENCY, OR SUICIDE-PREVENTION SERVICE. If you or someone else is in danger, in a mental-health crisis, or otherwise needs urgent help, contact local emergency services or a qualified crisis line immediately. Do not rely on Elara in any emergency.
5. Your Sole Responsibility
You are solely and fully responsible for: (a) how you use Elara, (b) any content you input, generate, store, or share, (c) any decisions you make based on Elara's output, (d) compliance with all laws and regulations applicable to you, and (e) any consequences whatsoever arising from your use. You agree not to use Elara for any illegal, harmful, harassing, defamatory, infringing, or abusive purpose.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OWNER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, PERSONAL INJURY, OR EMOTIONAL DISTRESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE ELARA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The owner's total cumulative liability shall not exceed the amount you paid for your copy of Elara, if any.
7. Indemnification
You agree to defend, indemnify, and hold harmless the owner from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of Elara, your content, your violation of these terms, or your violation of any law or right of any third party.
8. License
If you purchased a copy, you are granted a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Elara on devices you own or control, for your own personal use. You may not resell, redistribute, rent, lease, sublicense, reverse engineer for redistribution, or create derivative works for distribution. The license terminates automatically upon any breach of these terms.
9. Privacy
Elara stores all data you enter locally in your browser. The owner does not collect, receive, or have access to your data. Backups and exports you create are your responsibility. The owner is not responsible for any loss of data, including loss caused by clearing your browser, switching devices, software updates, or any other cause.
10. AI Output
Elara's output is generated by software and may be inaccurate, incomplete, biased, offensive, or otherwise undesirable. Output is not reviewed by the owner. You are responsible for evaluating the accuracy and appropriateness of all output before acting on it or sharing it.
11. Changes
These terms may be modified at any time without notice. Your continued use of Elara after any change constitutes your acceptance of the modified terms.
12. Severability & Governing Law
If any provision of these terms is held unenforceable, the remaining provisions remain in full force and effect. These terms are governed by the laws of the owner's jurisdiction of residence, without regard to conflict-of-laws principles.
13. Acceptance
By installing, accessing, purchasing, or otherwise using Elara, you confirm that you have read, understood, and agreed to these terms in full. If you do not agree, do not use Elara.
